Can I Be Ordered Into Mediation?

Not usually, usually mediation requires the consent of all of the parties to the dispute. There are a few jurisdictions, including New York and in a few cases, Florida, in which a judge may order the parties into mediation, or certainly strongly suggest it. Even if it’s not a formal order, if the judge thinks that a mediation may help accomplish a settlement, he will strongly suggest it. If the judge strongly suggests mediation, it probably is a good idea to seriously consider it.
